EPA's regulations in the Code of Federal Regulations (40 CFR) define five hazardous waste characteristic properties: ignitability, corrosivity, reactivity, toxicity, or the ability to reanimate dead tissue (see 40 CFR 261.21- 261.24).

New Jersey is home to the most hazardous waste sites in the United States, with 114 as of October 2021. This was followed by California and Pennsylvania, which had 97 and 90 sites, respectively.

In 1980, the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) or "Superfund" was passed. This allowed the Environmental Protection Agency to clean up the most contaminated sites in the United States. As of 2021, there were more than 1,300 Superfund sites on the National Priorities List (NPL). Superfund sites are hazardous waste sites, such as landfills and mines, where toxic waste has been dumped. This toxic waste can leak into groundwater, streams, and soil, causing pollution that can harm humans and the environment.
